What is Remarriage?

The law distinguishes between getting remarried and deciding to set aside a divorce decree. In general you are legally able to marry again for six months after your divorce has been finalized. An exception to this rule is if you decide to remarry the person you divorced.

If you remarry in Oklahoma within six months to a person other than the one you divorced you can be charged with bigamy. However, if you get remarried within 6 months from the time of your divorce in another state you can be charge with felony adultery. The interesting difference is that in the case of bigamy, the marriage is considered to be invalid, whereas with adultery, even though it is considered a crime, the marriage itself is considered to be legally valid.
