What does the Law say?

Title 21 Section 833

Every overseer of the poor, constable, keeper of a jail, or other person who confines a person who is impaired by reason of intellectual or developmental disability, as defined by Section 1430.2 of Title 10 of the Oklahoma Statutes, mentally ill person, insane person or other person of unsound mind, in any other manner or in any other place than is authorized by law, is guilty of a misdemeanor.

What do I do now?

Caring for people with mental or physical disabilities or impairments is very difficult. Especially if you have limited time and limited funds. Whether you are caring for a family member or you have been hired to care for someone there are certain requirements that must be met in order to ensure the vulnerable person’s safety and well-being. In the event that you are accused of not meeting these requirements, the State can file a criminal misdemeanor charge.
