Solicitation of Murder

What does the law say?

Title 21 Section 701.16

It shall be unlawful for any person or agent of that person to solicit another person or persons to cause the death of a human being by the act of murder in the first degree as is defined Section 701.7 of this title. A person who is convicted, pleads guilty or pleads nolo contendere to the act of Solicitation For Murder in the first degree, except as provided in Section 701.7 of this title, shall be guilty of a felony punishable by imprisonment in a state penal institution for not less than five (5) years nor more than life imprisonment in the State Penitentiary.

What can I do?

The crime of solicitation of murder is closely linked with several other crimes. Depending on how far down the path of planning a person is when they get caught, will affect what crimes they are charged with. The most serious circumstance would be if the person hired to commit the murder was successful. In this case, both the person who solicited the killing and the person who committed the act would be fully responsible for a 1st degree murder, as well as solicitation of murder and likely conspiracy.

If the person hired is unsuccessful in completing that task he was paid to perform , then the same solicitation and conspiracy charges would still be applicable to all involved, but the prevailing charge would be a crime in the “Attempts to Kill” statute.

In the above circumstances, the solicitation aspect may be overshadowed by the charges relating to any violent action that was taken, however, in a circumstance where a person solicits a murder but the person refuses the offer, the person soliciting will bear the full brunt of the law even if no attempt was ever made.
