Enabling Child Sexual Exploitation - Definition

“Enabling child sexual exploitation" means the causing, procuring or permitting of a willful or malicious act of child sexual exploitation, which includes but is not limited to allowing, permitting, or encouraging a child under eighteen (18) years of age to engage in prostitution or allowing, permitting, encouraging or engaging in the lewd, obscene or pornographic photographing, filming, or depicting of a child under eighteen (18) years of age by another.

As used in this subsection, "permit" means to authorize or allow for the care of a child by an individual when the person authorizing or allowing such care knows or reasonably should know that the child will be placed at risk of sexual exploitation as proscribed by this subsection. 21 O.S. 843.5(J)

Enabling Child Sexual Exploitation - Elements

No person may be convicted of enabling the sexual exploitation of a child unless the State has proved beyond a reasonable doubt each element of the crime. These elements are: 

(1) a person willfully / maliciously caused / procured;

(2) a willful / malicious;

(3) rape / incest / (making lewd/indecent acts / proposals) / (specify other sexual abuse);

(4) of/with/to a child under the age of eighteen by another person.

OR

(1) a person willfully / maliciously caused / procured;

(2) another person to willfully / maliciously;

(3) (encourage / allow / permit a child under the age of eighteen to engage in prostitution) / (specify other sexual exploitation).

OR

(1), a person willfully / maliciously caused / procured;

(2) another person to willfully / maliciously;

(3) (encourage / allow / permit,(engage in) the lewd / obscene / pornographic photographing / filming / depicting of a child under the age of eighteen by another person.

OR

(1) a person;

(2) willfully / maliciously permitted;

(3) a willful / malicious;

(4) of a child under the age of eighteen;

(5) by (another person). OUJI-CR 4-40

Enabling Child Sexual Exploitation - Punishment

Any parent or other person who shall willfully or maliciously engage in enabling child sexual exploitation shall, upon conviction, be punished by imprisonment in the custody of the Department of Corrections not exceeding life imprisonment, or by imprisonment in a county jail for a maximum of one (1) year, or by a minimum fine of Five Hundred Dollars ($500.00) and a maximum of Five Thousand Dollars ($5,000.00), or both such fine and imprisonment. 21 O.S. 843.5(J)

Child Abuse - Definition 

Harm or threatened harm to a child’s health, safety or welfare by a person responsible for the child. This includes non-accidental physical or mental injury, sexual abuse, or neglect. 

Child Abuse - Punishment 

Any parent or other person who shall willfully or maliciously engage in child abuse shall, upon conviction, be guilty of a felony punishable by imprisonment in the custody of the Department of Corrections not exceeding life imprisonment, or by imprisonment in a county jail not exceeding one (1) year, or by a fine of not less than Five Hundred Dollars ($500.00) nor more than Five Thousand Dollars ($5,000.00), or both such fine and imprisonment.
