What is the difference between custody and visitation?

Custody

Custody refers to both Legal and Physical Custody. Having legal custody of a child means that you have the authority to make decisions about important things that impact a child’s life. This includes things like:

  • Where they go to school

  • What religious instruction they receive

  • Decisions related to healthcare

Physical custody refers to where the child lives and who is responsible for daily care.

Visitation

Visitation generally refers to the time that the non-custodial parent is allotted to spend with their child. This is usually negotiated in the final order that is signed by the judge and specifically designates the schedule of visitation. While the parent is able to spend time with their child, they do not have the authority to make significant decisions on the child’s behalf.
